In a suit by plaintiff-students against defendant-private religious high school for discrimination based on sexual orientation in violation of the Unruh Civil Rights Act, grant of summary judgment in favor defendants is affirmed where: 1) defendant-school was not a "business enterprise"; and therefore 2) defendant was not subject to the Unruh Act.
