California Court of Appeal

In an action arising from defendant's termination of plaintiff-teacher, denial of petition for writ of administrative mandamus is affirmed where: 1) the trial court did not err in concluding defendant properly retained two teachers over whom plaintiff had seniority; and 2) defendant's error in failing to apply a tiebreaking criteria before laying off plaintiff was properly found by the ALJ not to be prejudicial.
