California Court of Appeal
People v. Harbert, A118186
Conviction and sentence for failure to stop and assist at the scene of an accident are affirmed where: 1) section 20001 of the Vehicle Code requires only constructive, not actual, knowledge that an accident has occurred, and a jury instruction to that effect was proper; and 2) a great-bodily-injury sentence enhancement was correctly applied.
