California Court of Appeal

Lucio v. City of Los Angeles, B201511

In a wrongful termination action by plaintiff-police officer, denial of petition for writ of administrative mandate is affirmed where: 1) defendant-city satisfied the one-year limitations provisions of Los Angeles City Charter (Charter) section 1070(c) because the matter was tolled for well in excess of 13 days, while the Los Angeles Police Department (LAPD) conducted a months-long internal criminal investigation into plaintiff's conduct; and 2) Charter section 1070(c)(1) applied with equal force to counts one and three.
