Denial of petition to review revocation of petitioner's license as a marriage and family therapist because petitioner engaged in sexual contact with a client is reversed where: 1) Government Code section 11517, subdivision (c)(2)(E)(ii) of the Administrative Procedures Act (APA) applies on remand; 2) the California Board of Behavioral Sciences failed to allow argument as required by that statute; 3) the Board abused its discretion because it failed to proceed in the manner required by law; and 4) the trial court erred in denying in denying the petition for writ of mandate.
