California Court of Appeal
Hines v. Lukes, B199971
In an appeal to a settlement between two neighbors concerning the scope of an easement, grant of motion for entry of judgment pursuant to a settlement is reversed with directions to enter a formal judgment setting forth all of the material terms that have yet to be fully performed or enter an order denying the settlement where: 1) the trial court properly considered the merits of the motion and opposition and found that defendant showed no basis to relieve her of her settlement obligations; but 2) the order erroneously failed to set forth all of the material settlement terms.
