California Court of Appeal
Fasuyi v. Permatex, Inc, A117760
In an action for personal injuries suffered by plaintiff-employee at workplace, default judgment in favor plaintiff is reversed where: 1) the totality of the circumstances demonstrated that defendant-employer was entitled to relief from the default and default judgment; and 2) not to grant such relief was an abuse of discretion, an abuse that was prejudicial to defendant.
