Rael v. Davis, B197971, B200217

In a breach-of-contract action, judgment for defendant and denial of defendant's attorney fees are affirmed where: 1) a settlement agreement prepared in the course of a mediation, but lacking the signatures of all parties, was properly excluded as inadmissible and was unenforceable; and 2) because the agreement was not enforceable, defendant was not entitled to his fees under the provisions of the agreement.
