In a contract matter involving investment in a limited partnership, petition for writ of mandate is granted where: 1) there is nothing to preclude dismissal of a complaint in trial court after the case has been ordered into arbitration but before arbitration has commenced; and 2) after a dismissal, the trial court no longer has jurisdiction to order the parties to complete the arbitration.
