People v. Esquibel, B165767
Conviction and sentence for four counts of attempted murder and count of assault with a firearm is modified and affirmed where: 1) the trial court is ordered to delete the section 12022.7 enhancement and the superior court is directed to prepare an amended abstract of judgment and forward it to the Department of Corrections; 2) there was no constitutional violation to defendant's statutory right to a public trial for exclusion of two spectators from the trial; and 3) any violation of defendant's right to an open trial was deminimus and not prejudicial.
