Chinn v. KMR Property Mgmt., B196321

In an action to recover attorney's fees in tort action, judgment granting portion of requested fees is affirmed in part and reversed and remanded in part where: 1) an attorney's fee provision of plaintiff's lease agreement allows the prevailing party to recovery attorney's fees in the instant tort action; 2) plaintiff was not precluded from recovering her costs under defendants' section 998 offer; and 3) plaintiff should not be awarded additional amount of costs because defendants were the prevailing parties for the purposes of an award of costs under section 1032.
