People v. Wills, D050280

Habeas petition challenging conviction and sentence based on guilty plea to committing a lewd act against a child under the age of 14 is denied where the court did not err to the extent it denied defendant's probation without expressly considering under Penal Code section 1203.066(c)(2) whether a grant of probation would have been in the then-11-year-old victim's best interests at the time defendant molested her in 1995.
