California Court of Appeal

City of Fremont v. Fisher, A116935

In eminent domain case, jury award of just compensation and temporary severance damages to defendants of nearly $600,000, is reversed as to award of temporary severance damages for a temporary construction easement where the trial court should have excluded expert testimony on temporary severance damages since defendants failed to show that the TCE interfered with their actual intended use of the property.
