McCann v. Foster Wheeler, B189898
In case where plaintiff, a 30-year California resident, had been exposed to asbestos during installation of a boiler in Oklahoma 50 years ago, which boiler was sold by a New York company, trial court's holding that Oklahoma's statute of repose barred the suit is reversed as choice of law principles dictate the application of California law, which does not bar the suit.
