Serv. Employees Int'l Union v. Colcord, A116364

In action for breach of fiduciary duty for secretly organizing a campaign to decertify a collective bargaining agent, judgment for compensatory and punitive damages in favor of plaintiff-union, defendants' former employer, is affirmed as to the award for salary and benefits paid. However, judgment is set aside as to the award of campaign costs incurred in unsuccessful bid to prevent decertification, as no substantial evidence supported a finding that these were proximately caused by defendants' tortious conduct.
