In suit for breach of a real estate purchase agreement, summary judgment for defendant is reversed as both of the following grounds for defendant's summary judgment motion failed as a matter of law: 1) there was no enforceable contract as plaintiff did not exist when the assignment agreement was executed; and 2) defendant's repudiation of the alleged contract did not cause plaintiff any harm since plaintiff was not ready, willing, and able to fund the purchase of the hotel.
