California Court of Appeal

Zenith Ins. Co. v. WCAB, B197186

In case where swimming pool technician injured his back in 2004, respondent erred in ruling that the requirement that employers provide notice under Labor Code section 4061 arose with the first payment of temporary disability indemnity in 2004. The injured worker's permanent and stationary status is not required before a physician's report can indicate the existence of permanent disability under Labor Code section 4660(d).
