Petition for writ of mandate brought by prosecution seeking to amend information to allege aggravating circumstances and secure a jury trial of those aggravating circumstances is denied as the California Supreme Court has disapproved of a similar procedure in People v. Sandoval, 41 Cal.4th 825 (2007), decided after the petition was filed in this case.
