Willdan v. Sialic Contractors Corp., B189153

In dispute arising from a project to refurbish a stretch of Santa Monica Boulevard in the City of West Hollywood, dismissal of defendant's cross-action for indemnity and declaratory relief, and an award of attorney's fees to cross-defendant, are reversed as defendant's claims are not barred by a settlement agreement since defendant alleged latent defects in material attributable in part to cross-defendant's negligence.
