Voices of the Wetlands v. Cal. State Water Res. Control Bd., H028021
In litigation arising from administrative approvals of a project to modify the Moss Landing Power Plant, denial of plaintiff's petition for writ of mandate is affirmed where: 1) the superior court had jurisdiction to hear and determine this dispute over an NPDES permit; 2) trial court's order for administrative remand was procedurally proper, and it was supported by sufficient evidence; 3) a certain administrative hearing was conducted properly; and 4) the trial court acted properly in affirming the agency's application of section 316(b) of the Clean Water Act to the NPDES permit at issue in this case.
