Ortiz v. Lyon Mgmt. Group, Inc., G037225
In class action alleging violations of the Investigative Consumer Reporting Agencies Act and the Consumer Credit Reporting Agencies Act regarding tenant screening reports used to assess rental applicants, summary judgment for defendant is affirmed as the ICRAA is unconstitutionally vague as applied to tenant screening reports containing unlawful detainer information. Moreover, defendant could not obtain class certification after the court decided the merits of plaintiff's individual claim.
