People v. Givan, F050822

Order of commitment to the Department of Mental Health, after finding of not guilty by reason of insanity of two felonies and one misdemeanor, is affirmed over defendant's claims that: 1) the court erred by allowing him to waive his rights without requiring a personal appearance to do so; and 2) his waiver of his rights was invalid since there was no evidence in the record of his knowledge or his waiver of his right to trial by jury.
