California Court of Appeal
Jafari v. EMC Ins. Cos., B192640
In coverage dispute stemming from an action in which a customer sued the insured for, among other claims, assault and battery committed by the insured's business manager, summary judgment for insurer is reversed where the trial court erred in finding the insurer had no duty to defend as existing case law indicates acts committed by an insured in self-defense can be deemed an accident, instead of intentional and deliberate.
