Capen v. Shewry, C047172

In declaratory relief action challenging requirement that surgical clinic obtain a license since non-owner physicians will use it, summary judgment for plaintiff is affirmed where Health and Safety Code section 1204(b)(1) excludes physician owned and operated surgical clinics from licensing by the Department of Health Services, leaving them, when using general anesthesia, to accreditation and regulation by the Medical Board.
