The First Amendment right of access to certain judicial proceedings does not extend to post-indictment grand jury transcripts at a Penal Code section 938.1 hearing, and a defendant seeking to seal such transcripts pending the completion of trial need only establish prejudice under the lesser "reasonable likelihood" standard of section 938.1.
