California Court of Appeal

Lingenfelter v. County of Fresno, F050021

In suit filed after plaintiff's son died in foster care, judgment for defendants is reversed where the trial court erred in granting defendant's motion for nonsuit, on plaintiff's claim for intentional infliction of emotional distress, as the validity of the third cause of action did not depend on plaintiff's status as guardian of her son at the time the events allegedly occurred.
