In dispute concerning use of a common area in a condominium building, judgment for defendant association is affirmed over claims that the court abused its discretion by: 1) granting nonsuit on the causes of action for nuisance and defamation; 2) refusing to grant declaratory and injunctive relief; and 3) refusing to modify jury instructions pertaining to the availability of nominal damages for breach of contract. Moreover, plaintiffs challenge the timeliness of the defendants' memorandum of costs.
