California Court of Appeal
Sheehan v. San Francisco 49ers, Ltd., A114945
In suit alleging violations of the state constitutional right to privacy based on the professional football team the San Francisco 49ers' patdown policy mandated by the National Football league, sustaining of demurrer is affirmed where plaintiffs cannot demonstrate that they had a reasonable expectation of privacy since by attending the 2005 season games, they had advance notice of the patdown policy and thereafter impliedly consented to the patdowns by voluntarily purchasing 2006 season tickets.
