People v. Caesar, D050387

Convictions and sentences arising out of a confrontation between two groups of men in which guns were fired, killing one man and injuring several others, conviction of one defendant for attempted premeditated murder is reduced to to attempted unpremeditated murder. Also, the case must be remanded for resentencing where the court imposed an upper term sentence based on facts not found by a jury.
