California Court of Appeal

Jones v. Cal. Dep't Corr. & Rehab., D048281

In sexual harassment suit brought by African-American female, summary judgment for defendants-employer and individual supervisors is affirmed where: 1) plaintiff failed to establish a triable issue of material fact as to whether she experienced harassment, discrimination and retaliation under California's Fair Employment and Housing Act; 2) causes of action for assault and battery and emotional distress were barred by the workers' compensation exclusivity rule; and 3) a negligent supervision cause of action also failed because it was based on plaintiff's claims of discrimination and assault and battery.
