California Court of Appeal

People v. Morton, G036413

A conviction on charges of domestic battery with corporal injury and misdemeanor assault is affirmed over claims that the trial court: 1) abused its discretion in allowing the jury to hear evidence he had engaged in a prior, uncharged incident of domestic violence; and 2) erred by following California Supreme Court precedent, in People v. Black (2005) 35 Cal.4th 1238, in its application of California's determinate sentencing law.
