California Court of Appeal

People v. Cole, F050978

Sentence based on prior strike conviction, occuring in adult court when defendant was 16 years old, is affirmed over claims that: 1) the strike sentence in the current case must be set aside because the Legislature did not intend to treat nonforcible sex between minors as a strike; and 2) imposing a strike sentence on him violated principles of equal protection as a juvenile adjudication for the same offense is not a strike.
