Conviction and sentence for corporal injury to a cohabitant, assault by means likely to produce great bodily injury, and disabling a telephone line is affirmed over claims that: 1) defendant cannot be convicted of three violations of Penal Code section 273.5; 2) allowing evidence of an out of court statement of a previous victim violated his right to confrontation and cross-examination; and 3) there was insufficient evidence to convict him of disabling a utility line as there was no evidence his conduct was "unlawful." However, sentence is modified to provide defendant 36 days of presentence custody credit.
