Fergus v. Songer, B182525

In an action brought to collect on attorney's fees and alleging breach of a partnership agreement, an order granting defendant's motion for a new trial on the issue of damages is reversed and a $1,200,000 judgment against defendant is reinstated. Additionally, the trial court erroneously granted a motion in limine excluding evidence of an oral partnership agreement involving plaintiff-attorney's wife, which was the functional equivalent of the granting of a nonsuit as to her causes of action based on the partnership agreement.
