In case alleging elder abuse and wrongful death in caring for 83-year old woman recovering from recently-repaired fractured hip, denial of defendants' petition to compel arbitration is affirmed where the arbitration agreements exclude from arbitration: 1) a patient's claims under Health and Safety Code section 1430(b) for violations of the Patients Bill of Rights; and 2) survivors' claims for wrongful death.
