California Court of Appeal

Stonelight Tile v. California Ins. Guar. Ass'n, H029043

In insurance coverage dispute arising from litigation over damages from repeated exposure to dust from recycling operations, summary judgment for insurer is affirmed over claims that: 1) no other insurance was available to plaintiffs as defendant's scope of coverage was different from that of the other insurers whose policies were triggered; and 2) the continuous trigger of coverage that obligates the other insurers to pay the judgment in the underlying action in full, subject to a right of contribution, does not apply to plaintiffs' claims for nuisance and trespass.
