California Court of Appeal

Parker v. Wolters Kluwer United States, Inc., B190805

After previous orders and monetary sanctions failed to bring about compliance with discovery, sanctions imposed on plaintiff by dismissing his complaint against all defendants and entering his default on the cross-complaint brought by two of the defendants, are reversed as to one of the monetary sanction orders where it was error to impose terminating sanctions in favor of parties who did not propound discovery themselves or show how they were prejudiced by plaintiff's failure to comply with the discovery requests propounded by others.
