In a construction defect action, petitions for writ of mandate challenging grant of motion for determination of good faith settlement are granted where the court erred in making its finding based solely upon a limitation of liability clause, without considering real party's proportionate share of liability to the other defendants on their claims for implied indemnity or contribution against real party.
