California Court of Appeal

Golden Eagle Ins. Corp. v. Cen-Fed, Ltd., B179851

Decision that insurer owed neither a defense nor an obligation to indemnify defendant for damages awarded against it in underlying action for breach of a lease for commercial premises is affirmed. However a ruling that insurer was obligated to pay, under supplementary payments provisions of its policy, the attorney fees and costs awarded against defendant in the underlying action is amended as plaintiff's burden under the supplementary payments clause is an integral part of, and can be no broader than, its duty to defend.
