California Court of Appeal
Ross v. San Francisco Bay Area Rapid Transit Dist., A110543
In action for wrongful termination and age and disability discrimination, summary judgment for defendant is affirmed where: 1) Government Code section 815.2(b) provides immunity to a public entity for its vicarious liability for the wrongs of its employees and its own direct liability; 2) the trial court correctly found that plaintiff failed to make a prima facie showing of age discrimination; and 3) plaintiff's notation on his FEHA complaint that he was "36.5% disabled" did not create a triable issue over whether he exhausted administrative remedies.
