California Court of Appeal

Kurwa v. Harrington, Foxx, Dubrow & Canter, LLP, B187363

In case involving opthalmology practice where one of the physician owners had his license suspended and other owner physician had law firm send letter to HMO to transfer agreement to his new organization, denial of special motion to strike a suit filed against defendant lawyers for tortious interference with contractual relations is affirmed over claims that: 1) the mailing of the letter constitutes a public forum; and 2) the subject matter of the letter potentially impacted thousands of patients and is a matter of public interest.
