In sexual harassment action in which plaintiff student while visiting an incorporated charter high school was subjected to sexual banter and comments directed at her, including from a teacher, summary judgment for defendants on the ground that plaintiff failed to comply with meeting the claim presentation requirements of the Government Tort Claims Act, is reversed as claims against the incorporated charter school need not satisfy the TCA since the school is not a "public entity." (On Rehearing)
