In case involving proposition outlawing state discrimination or preferences based on race, gender or national origin, judgment on the pleadings, and judgment declaring invalid Government Code section 8315, which attempted to exclude "special measures" taken to secure advancement for certain racial or ethnic groups, is reversed as, with the finality of C&C Constr., Inc. v. Sacramento Mun. Util. Dist. (2004) 122 Cal.App.4th 284, and defendants' acceptance of its holding, there is no longer a justiciable controversy surrounding section 8315.
