In dispute between Plaintiff Oakland Raiders professional football organization and Defendant Oakland-Alameda County Coliseum, Inc. alleging misrepresentation regarding season ticket sales in order to induce the Raiders to leave Los Angeles and sign a long-term contract to play in Oakland: 1) a multi-million dollar damage award against defendant and denial of attorney fees is vacated; 2) defendant's motion for judgment notwithstanding the verdict on fraud claim is reversed as the Raiders' conduct amounted to an implied waiver of the claim; and 3) the Raiders' appeal from denial of attorney fees is dismissed as moot.
