California Court of Appeal

Marriage of Leni, C047305

Orders holding wife had no fiduciary duty to sell house to husband, and that a notation in escrow instructions to split the proceeds of a sale of a house owned was not a valid transmutation of community property to husband's separate party as he spent community funds to care for his mother, is reversed to the extent husband was ordered to reimburse wife in payment of her one-half community interest in the sale of one of their homes.
