Robertson v. Fleetwood Travel Trailers of Cal., Inc., F048123

In case involving purchase of new travel trailer from defendant with a persistent water leak trailer that was not repaired within a reasonable number of attempts, jury verdict for plaintiffs finding defendant violated the refund-or-replace provisions of the Song-Beverly Act and award of damages plus a civil penalty for defendant's "willful" failure to comply with its statutory obligations, with award of attorney fees from trial court, is reversed only as to award of attorney fees where the trial court considered some of the same factors in reaching the lodestar amount as it did in applying a multiplier, resulting in unfair double counting.
