Summary judgment for defendant, in case brought by convicted criminal against his former attorney for breach of contract and professional negligence, is reversed where the trial court erred in holding that in order to prevail, plaintiff had to prove he was actually innocent of the crime of which he was convicted, when the contract claim was only a fee dispute and the professional negligence claim only related to seized property.
