California Court of Appeal

Robinzine v. Vicory, A108176

Denial of motion to strike malicious prosecution cause of action, under the Strategic Lawsuit Against Public Participation statute, is reversed as a malicious prosecution cause of action does not arise from an unsuccessful petition under the Workplace Violence Safety Act and, thus, plaintiffs could not have established a likelihood of prevailing on the merits of a malicious prosecution claim and it should have been stricken.
