Red Mountain, LLC v. Fallbrook Pub. Util. Dist., d044546a.pdf

Judgment for plaintiff for breach of contract, inverse condemnation, and compensation for direct taking in eminent domain, and attorney fees and costs, is reversed as the trial court's erroneous interpretation of an access easement and its misdirection of the jury on that point prejudicially affected the outcome of the trial with respect to plaintiff's claims for inverse condemnation and breach of contract, and these errors, in turn, may have prejudicially affected the jury's determination of just compensation on defendant's direct condemnation claim. (Amended)
