El Dorado Irrigation Dist. v. State Water Res. Control Bd., C046211

Order that defendant set aside decision to include standard term in water appropriation permit, requiring curtailment of diversion of water when federal bureau of reclamation or state water resources department release stored water from certain water projects to meet water quality objectives, is affirmed where defendant abused its discretion in imposing the standard term and such action contravened the rule of priority, as appropriators junior to plaintiff can divert water when plaintiff cannot.
